Agreement

These terms govern your use of Run, a product of Modryn Studio LLC (Modryn Studio), available at run.trading. By using Run, you agree to these terms. If you do not agree, do not use Run.

What Run is

Run is a trading-discipline companion. It keeps a record of your trading, reflects it back to you, and can help you hold to limits you set for yourself. Run is currently in beta.

Not financial advice

Run does not provide financial, investment, or trading advice. Nothing in Run is a recommendation to buy, sell, or hold any instrument. You are solely responsible for your own trading decisions and their outcomes.

Trading futures carries substantial risk, and you can lose more than you deposit. Run may be wrong, late, or unavailable, and it may fail to warn you or to hold a limit you set for yourself. You agree not to rely on Run to prevent any trading loss, and any decision to trade or to stop trading is yours alone.

Run does not place trades

Run does not place, change, or cancel trades on your behalf, and it does not hold your funds. If you connect a brokerage account, Run reads your activity. Any limit or lockout is one you arm yourself, on your own account, and you remain in full control of your account and your orders.

Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use Run.

Your account

You are responsible for keeping your sign-in secure and for activity under your account. Tell us at support@run.trading if you believe your account has been used without your permission.

Acceptable use

Do not misuse Run. That includes attempting to break or bypass its security, accessing data that is not yours, interfering with its normal operation, or using it for anything unlawful.

Your data

You own your trading records. To operate Run for you, you give Modryn Studio permission to store, process, and display that data, and to send only the figures and messages needed to the providers listed in our Privacy Policy. This permission lasts while you use Run and ends when we delete or de-identify your data, apart from records we must keep by law and copies held in backups until they expire. You can export your trading records, and you can ask us to delete them, as described in that policy.

Beta and availability

Run is provided on an as-is and as-available basis during the beta. Features may change, break, or be removed, and we do not guarantee that Run will be available without interruption or error.

Third-party services

Run works with services you connect or that we rely on, such as your broker and our infrastructure providers. We are not responsible for those third-party services or their acts.

Disclaimers and limitation of liability

RUN IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. To the fullest extent permitted by law, Modryn Studio disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Run will be accurate, uninterrupted, error-free, or that it will prevent any trading loss.

To the fullest extent permitted by law, Modryn Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or trading losses, arising from or relating to your use of Run, even if we were advised that such damages were possible. To the fullest extent permitted by law, Modryn Studio's total liability for all claims relating to Run will not exceed the greater of the amount you paid us for Run in the twelve months before the claim or one hundred US dollars. Some jurisdictions do not allow certain of these limitations, so parts of this section may not apply to you.

Termination

You may stop using Run at any time. We may suspend or end access if these terms are violated.

Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page. Continued use of Run means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules. Modryn Studio LLC is a Wisconsin limited liability company. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Wisconsin, and you agree to bring any dispute only in your individual capacity, and not as a plaintiff or class member in any class or representative action.

General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. These terms are the entire agreement between you and Modryn Studio about Run.
